TERMS AND CONDITIONS
FOR INTERNATIONAL STUDENTS ENROLLING AT NZIS
1. AGREEMENT
1.1 We will provide the student with education and accommodation services in accordance with the selection of services made by you on the registration form.
1.2 We will from time to time following commencement of your placement provide you with activity services or introduce you to third party activity service providers, on such additional terms as shall be agreed on an activity by activity basis.
1.3 We will provide the above services selected by you in accordance with these terms and conditions, our policies, operating standards, student rules and regulations and the New Zealand Ministry of Education Code of Practice for the Pastoral Care of International Students.
1.4 You will comply with all terms and conditions, policies and rules and regulations that apply to you including but not limited to our published regulations within our student handbook.
1.5 Copies of any documents referred to in clause 1 above will be made available on request.
2. FEES
2.1 Our fees will be charged in accordance with the fee schedule current at the time of processing of your registration form.
2.3 All course fees shall be paid by you in full 10 days prior to the commencement of the course. If fees are not paid in such time then we reserve the right to decline the course placement.
2.4 An 8 week advance of homestay fees shall be paid by you in full 10 days prior to the commencement of the course (except for courses shorter than this duration).
2.5 All fees are calculated in complete weeks and any part of a week is counted as a full week. No compensation is given for public holidays when we are closed.
2.6 All students fees paid to NZIS are held in the Public Trust and are only paid to NZIS monthly based on pro rate of tuition delivered. In the unlikely event of insolvency, regulatory closure or withdrawal or accreditation of the New Zealand Institute Of Sport, students should apply to The Public Trust for a refund of the undelivered portion of tuition.
3. WITHDRAWALS AND REFUNDS
3.1 Should the student withdraw from our course at least 8 days prior to its commencement, we will refund you all course fees minus the registration fee and homestay registration fee.
3.2 Should the student withdraw from our course less than 8 days prior to the course commencing or less than 8 days after the course commencement, we will refund you all fees minus 10% of course fees or NZ$500 (whichever is lesser), minus the registration fee and minus the homestay registration fee.
3.3 Should the student withdraw from our course due to the failure to obtain a visa, all fees are refunded minus the registration fee and homestay registration fee.
3.4 No refunds will be made if the student withdraws from a course more than 8 days after its commencement.
3.5 All applications for refunds must be made in writing. Notwithstanding clauses 3.1 – 3.4 inclusive, genuine and valid reasons will be required before any refund is payable by NZIS to you.
3.6 If you require a refund, you must return all original documents and acceptance letters provided by us.
3.7 Refunds are paid directly to you. If you are applying from outside New Zealand, refunds will be sent to your last known address in the country you have applied from. Students enrolling through agents will have their refunds sent directly to students.
3.8 Fees cannot be transferred to any other person or institution.
4. HOMESTAY POLICY
4.1 We will endeavour to arrange and place students in appropriate homestays in accordance with the information provided by you on the application form.
4.2 In addition to our rules and regulations, the student will comply with the rules set down by the homestay family.
4.3 If you have some problem or are unhappy with your homestay family, you can discuss it with the International Liaison Officer and follow the complaints procedure as already outlined in the student handbook.
4.4 New students must stay at the homestay provided by us for a minimum period of two weeks (unless matured students have made prior arrangement with the institute). If after the 2 weeks period the student wishes to move out then the student must give a further 2 weeks notice of departure (minimum period of stay – 4 weeks)
4.5 Changes to homestay accommodation may incur a fee set at the discretion of NZIS.
4.6 Students below the age of 18 must stay at homestays arranged by us.
4.7 If a student’s parents select accommodation for the student, the parents must sign an indemnity form stating that the parents take full responsibility for the placement of the student with the designated caregiver.
5. ACCOMMODATION (OTHER)
5.1 NZIS will in no circumstances be responsible for rental or any other costs with respect to students entering into private accommodation agreements with a landlord and the student agrees to indemnify NZIS against all responsibility for such costs with respect to the student’s accommodation.
6. ATTENDANCE AND BEHAVIOUR
6.1 The student is expected to attend all lessons and student activities punctually and must comply with his/her permit to stay in New Zealand.
6.2 Poor attendance may lead to the student’s expulsion from our language school.
6.3 New Zealand Institute of Sport must uphold the regulations imposed by NZQA accreditation and NZ immigration office. Students must show an attendance of 85% (or above) to fulfil the general requirement.
6.4 Students must observe rules and regulations listed out in our student handbook.
6.5 A verbal warning is normally given for breaches of our rules. A further breach will incur a written warning. The receipt of two written warnings may result in suspension or expulsion from our language school. A copy of the written warning is sent to parents for students under the age of 18.
6.6 In case of serious breaches of our rules and regulations, suspension or expulsion may be immediate.
7. NOTICE OF ADDRESS
7.1 You will keep us at all times informed of your current address and phone number in New Zealand while undertaking one of our courses. You agree that this is an important term of agreement between us, the breach of with shall entitle us summarily to terminate this agreement and to expel you from the school.
8. GRIEVANCE PROCEDURES
8.1 If you feel a staff member has unfairly treated you, or are unhappy with NZIS in some way, you can discuss it with the staff member concerned.
8.2 If you are unable to solve the issue by approaching the staff member, you may discuss the issue with the Quality Assurance Director. You may wish to have a support person present at this discussion, if so, please inform the Quality Assurance Director before the meeting.
8.3 The Quality Assurance Director will discuss the complaint with you, and complete a Complaints Form. This ensures that the issue is clearly identified and not forgotten. The Quality Assurance Director will then attempt to resolve the issue.
8.4 If you are not satisfied with the outcome, you may raise your complaint with an outside agency such as:

9. STUDENT GUIDANCE AND SUPPORT SYSTEMS
9.1 All students shall have access to appropriate guidance, support and counseling to ensure that their learning needs are met.
9.2 Students are expected to take responsibility for recognising their own needs and are encouraged to approach the Student Guidance and Support Person when they require assistance.
9.3 Tutors have responsibility for recognising the support and guidance needs of the students and guiding them to the Student Guidance and Support Person or towards relevant support agencies.
10. INSURANCE
10.1 You must have personal insurance to cover you for:
- Accident or illness
- Loss or damage to property
- Theft
- Loss of fees
10.2 NZIS is not liable for any loss, damage or injury to students or their property including any consequential losses.
10.3 NZIS is not liable to a student if services cannot be delivered due to reasons beyond its control.
10.4 NZIS will not be liable for the cost of any medical treatment or medication while you remain in New Zealand. It is the student’s obligation to obtain insurance that will cover the cost of medical treatment in New Zealand for the duration of his/her stay in New Zealand. It is also the responsibility of the student to obtain insurance to cover his/her travel to and from New Zealand.
11. HEALTH AND SAFETY
11.1 All employees and students are accountable for ensuring their actions at work do not harm themselves or anyone else.
11.2 Students are required to report all accidents to tutors and complete the accident register form.
11.3 Students must take responsibility for their own safety and health.
11.4 Students are required to follow instructions regarding hazards and emergency procedures.
11.5 Students must observe health and safety considerations listed out in the student handbook.
11.6 Many sporting activities have the potential for injury. NZIS has in place risk identification and management systems to ensure that all course activities are carefully controlled and monitored. Students will have the right to exercise their own judgement as to whether they are ready and confident to undertake an activity. Remember no one can force you (student) to undertake an activity you feel is beyond you (student).
11.7 In the event the student suffers a personal injury or illness at any time during their course in New Zealand, you consent to the arrangement of such medical intervention as is necessary to preserve life and/or well - being by us, our agents and/or third party service providers and you release us from any liability in respect of such action, and will indemnify and hold us harmless for all cost or liability we incur in respect of such action.
12. WARRANTY/CONSENTS
12.1 You warrant that as a party to this agreement you are a person over 18 years and/or have legal capacity to execute this agreement on behalf of the student.
12.2 If you are not the student, then you warrant that you have explained to the student all their obligations under this agreement.
13. TERMINATION
13.1 If you fail to meet your obligations under this agreement, we will send a written notice to you at your last known address in New Zealand explaining to you what is wrong, what needs to be done and when it must be done. If you do not comply with that notice, we may terminate this agreement immediately.
14. PRIVACY ACT
14.1 We will hold personal information about you so that we may carry out our responsibilities under this agreement and otherwise.
14.2 You will have the right to correct personal information held about you. You and we agree that information held by us as to your academic progress is evaluative material and not personal information.
14.3 We may check and disclose the personal information we hold about you to such persons as credit agencies, homestay providers, activity providers and the New Zealand Immigration Service.
15. NEW ZEALAND LAW
15.1 The proper law of this agreement shall be New Zealand Law and the parties agree that the forum for any dispute not resolved under clause 8 shall be the New Zealand Courts.
16. DEFINITIONS
“We”, “Us” and “Our” means New Zealand Institute of Sport both in Wellington and Christchurch.
“You” means the person executing the agreement, other than in clause 12, this means the student.
“Student” means the person who is enrolling with NZIS.
